BSAMS makes a good point. It is hardly uncommon for longstanding government practices to continue until someone actually notices, and objects to, the legality of the act.

With that being said, however, I suspect Obama and Clinton are okay if, in fact, she takes the job at the lower salary. Typically, clauses such as this are intended to prevent a legislator from voting him or herself a patronage job or raise. As such, there is a good chance a court would rule that reducing the salary to that which existed prior to Clinton taking office would probably comply with the intent of the law.

Really, a bigger issue should be whether or not she's qualified, given her long history of shenanigans in various offices, including as First Lady and her laughable foreign policy experience (sniper fire in Bosnia, anyone?).
