Judge Tosses Harassment Suit, Says Woman Too Smart to Have Been Abused

A Spanish judge has thrown out a woman's harassment suit against her ex-husband on the grounds she has a good education, arguing that had she really suffered abuse during their 16-year marriage she would have reported it right away or sought counseling.

Women's advocacy groups voiced outage over Wednesday's ruling by a judge in the northern city of Valladolid, and Spain's ruling Socialist party asked a judicial oversight board to review it.

The plaintiff, a high school teacher whose name has not been released, filed the suit last month arguing that her husband subjected her to psychological harassment throughout their 16-year marriage. They separated three years ago.

Judge Jose Luis Chamorro, who heads a court specializing in gender violence cases, cast doubt on the woman's claims.

He said he found it "surprising" that a woman with her level of education would put up with that alleged treatment for so many years without reporting it or seeing a psychiatrist, and "curious" that she is filing suit now, years after the marriage fell apart.

The judge has some good points. Without all the facts present, I am unwilling to commit to either side, but I have suspicions that the judge might be right in this case.

She waited three years after separation? That's grounds for separation! If she didn't report it then, it probably didn't happen.

I have heard about some women who will stay married to a very wealthy man, even if they are abused by that man.

They love the lifestyle that wealth brings so much, that they put up with any abuse.

Then, if the husband dies before they do, they inherit all his money and consider it worth it.

And that is sad.

Being rich should not be a sufficient reason to endure any abuse. .. but, people being people... etc, etc..

Women will also stay with an abusive man even when he is not rich. This may be due to low self esteem issues, or the fact that the woman might think she'll never find another man who will love and want her, so she may settle on such a man.

Or, the man only becomes abusive after they are married.

Or, a woman may want to get back at a man who wants a divorce by saying she was abused.

None of this may have been the case here. I do not know.

I'm just mentioning possible reasons for this.

What do you call a woman with two black eyes?

A woman who wouldn't listen the first time.

Jerry, your rational reasoning doesn't apply here. We are discussing women.

I believe they call this fetching.

Abuse laws are for people who are genuinely scared and she isn't one of them. Being unmarried myself I don't claim to be the marriage expert, but she overcame the divorce rate of the country for 16 years, so whatever "abuse" he did to her she forgave by sharing a room and a bed with him, and probably exchanged some fluids every now and then unless she had a headache.

Now that the marriage is over, she wants to rewrite history in her own little soap opera fantasy version of Oracle of Ages.

And she educates high school students for a living.

What a dumb dumb. Reminds me of an old flame.

I used to roam the world fighting monsters and sleeping in mud. Now look at me, living in a castle, sleeping in a bed. Aren't I sweet? Yuck!
