Associated Press: - A Border Patrol agent trying to stop a vehicle that had illegally entered the U.S. was struck and killed Saturday in southeastern California, agency officials said.
The agent was killed about 20 miles west of Yuma in the Imperial Sand Dunes Recreation Area, a spot along the border that is popular with off-road vehicle enthusiasts and frequently used by smugglers.
The agent attempted to impede the vehicle's progress before he was hit, but the Border Patrol did not immediately have more information, said agent Eric Anderson, a spokesman for the agency's Yuma sector.

Supreme Court Sides With Texas in Dispute With Bush Over Mexican's Death Row Case- President Bush overstepped his authority when he ordered a Texas court to reopen the case of a Mexican on death row for rape and murder, the Supreme Court said Tuesday.
In a case that mixes presidential power, international relations and the death penalty, the court sided with Texas 6-3.
Bush was in the unusual position of siding with death row prisoner Jose Ernesto Medellin, a Mexican citizen whom police prevented from consulting with Mexican diplomats, as provided by international treaty.
An international court ruled in 2004 that the convictions of Medellin and 50 other Mexicans on death row around the United States violated the 1963 Vienna Convention, which provides that people arrested abroad should have access to their home country's consular officials. The International Court of Justice, also known as the world court, said the Mexican prisoners should have new court hearings to determine whether the violation affected their cases.
Bush, who oversaw 152 executions as Texas governor, disagreed with the decision. But he said it must be carried out by state courts because the United States had agreed to abide by the world court's rulings in such cases. The administration argued that the president's declaration is reason enough for Texas to grant Medellin a new hearing.
Chief Justice John Roberts, writing for the majority, disagreed. Roberts said the international court decision cannot be forced upon the states.
The president may not "establish binding rules of decision that pre-empt contrary state law," Roberts said. Neither does the treaty, by itself, require individual states to take action, he said.
This has got to be a real quandry for whomod. On one hand, he's gotta be thrilled that Bush was rebuked on anything, given his level of Bush hate. On the other, Bush was fighting for the rights of an illegal immigrant and against the death penalty, two issues near and dear to whomod's heart. Heh. Why would you think this is so hard an issue for me? For one, what difference does it make what I think of Bush, illegal immigration, or even the death penalty? The issue here is are we going to honor our treaties or as the Supreme Court arrogantly states, are we some island unto ourselves where the very treaties we sign and the treaties we expect other countries to follow when it comes to our citizens apply to everyone else but ourselves. To me this is a lot like the Geneva Conventions. When it comes to our soldiers, we'd expect them to be honored but when it comes down to the way we handle detainees, we seem to think there's an exception to be made. All these sorts of decisions do is cause resentment abroad and make the world a much more dangerous place for the average American in the world since we no longer can expect anyone else to honor treaties if we do the same. We lose that moral high ground which with to protest. I can't figure out Robert's logic. If the United States signed a treaty, then isn't Texas part of the United States and thus must also honor that treaty? Not knowing the details of course and just going by the article posted here but it sounds like 'states rights' gone awry. Justices Stephen Breyer, Ruth Bader Ginsburg and David Souter dissented.
The international court judgment should be enforced, Breyer wrote. "The nation may well break its word even though the president seeks to live up to that word," he said.
Justice John Paul Stevens, while agreeing with the outcome of the case, said nothing prevents Texas from giving Medellin another hearing even though it is not compelled to do so.
"Texas' duty in this respect is all the greater since it was Texas that — by failing to provide consular notice in accordance with the Vienna Convention — ensnared the United States in the current controversy," Stevens said.

I haven't looked at the actual decision yet but I believe that the reason for overturning Bush was form of the order, namely, executive vs judicial.
I think the court held that the proper course was for the Department of Justice to seek a court order to overturn the execution/conviction. Instead, Bush issued an executive order.
Generally, executive orders are used for matters involving the conduct of the executive branch of the federal government, not the conduct of the judicial branch of a state.
Furthermore, it would seem to me that Bush could have issued a presidential pardon, which he is empowered to do, or even perhaps an order of clemency, instead of an executive order.

The rancher, Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol after they destroyed his property, killed his calves and broke into his home
The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.
Attorneys for the immigrants — five women and 11 men who were trying to cross illegally into the United States — have accused Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape.
His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally, the newspaper reports.
Reasonable people can disagree on immigration policy but the idea that people who aren't even citizens can trespass on this guy's land, destroy his property and break into his home, and then sue the guy for defending himself...is pretty fucked up. He should have just shot them and buried them out in the desert.

Gov’t going after hiring of illegals- An Obama administration policy to go after employers who knowingly hire and exploit illegal workers is not significantly different from the Bush administration strategy, according to a copy of the guidelines, obtained by The Associated Press.
The new guidelines for immigration agents, which the Homeland Security Department calls a “renewed department-wide focus” will impose fines and criminal charges against employers who break the law.
While the priority is to go after employers, the policy states that agents will continue to arrest illegal workers.

9th Circuit rejects appeal by rancher who imprisoned 16 border-crossers- Federal appellate judges have refused to overturn the civil verdict against a Cochise County rancher found guilty of illegally imprisoning 16 border crossers.

It's the word and the concept completely abandoned during the immigration debate: assimilation. Over the last year, hundreds of thousands of illegal-alien demonstrators took to the streets lobbying for amnesty. Marchers waved "Amnestia Ahora!" placards in one hand, the flags of their native countries in the other. Open-borders strategists quickly replaced the foreign flags with Old Glory after militant activists caused a public backlash last year. National newspapers played dutiful propagandists and splashed patriotic photo-ops of the "undocumented" masses wrapped in red, white and blue to drum up sympathy. But now that they've lost their amnesty fight, will they still embrace American symbols and traditions? Or was it all for show? And what of all that talk of illegal aliens being willing to study citizenship and civics? And take English classes? Why must they be bribed with the promise of a temporary guest-worker visa and mass governmental pardon in order to adapt to our way of life? When did assimilation become the means and not an end in itself? The inflection point can perhaps be traced to the moment when politicians were permitted to invoke the "America-is-a-nation-of-immigrants" platitude as a mindless justification for open borders. The fact is: We are not a "nation of immigrants." This is both a factual error and a warm-and-fuzzy non sequitur. Eighty-five percent of the residents currently in the United States were born here. Sure, we are almost all descendants of immigrants. But we are not a "nation of immigrants." (Isn't it funny, by the way, how the politically correct multiculturalists who claim we are a "nation of immigrants" are so insensitive toward Native American Indians, Native Alaskans, Native Hawaiians and descendants of black slaves who did not "immigrate" here in any common sense of the word?) Even if we were a "nation of immigrants," it does not explain why we should be against sensible immigration control. And if the open-borders advocates would actually read American history instead of revising it, they would see that the Founding Fathers were emphatically insistent on protecting the country against indiscriminate mass immigration. They insisted on assimilation as a pre-condition, not an afterthought. Historian John Fonte assembled their wisdom: - * George Washington, in a letter to John Adams, stated that immigrants should be absorbed into American life so that "by an intermixture with our people, they, or their descendants, get assimilated to our customs, measures, laws: in a word soon become one people."
* In a 1790 speech to Congress on the naturalization of immigrants, James Madison stated that America should welcome the immigrant who could assimilate, but exclude the immigrant who could not readily "incorporate himself into our society."
* In 1802, Alexander Hamilton wrote: "The safety of a republic depends essentially on the energy of a common national sentiment; on a uniformity of principles and habits; on the exemption of the citizens from foreign bias and prejudice; and on that love of country which will almost invariably be found to be closely connected with birth, education and family."
* Hamilton further warned that "The United States have already felt the evils of incorporating a large number of foreigners into their national mass; by promoting in different classes different predilections in favor of particular foreign nations, and antipathies against others, it has served very much to divide the community and to distract our councils. It has been often likely to compromise the interests of our own country in favor of another.
"The permanent effect of such a policy will be, that in times of great public danger there will be always a numerous body of men, of whom there may be just grounds of distrust; the suspicion alone will weaken the strength of the nation, but their force may be actually employed in assisting an invader."
* The survival of the American republic, Hamilton maintained, depends upon "the preservation of a national spirit and a national character." "To admit foreigners indiscriminately to the rights of citizens the moment they put foot in our country would be nothing less than to admit the Grecian horse into the citadel of our liberty and sovereignty."
We are not a nation of immigrants. We are first and foremost a nation of laws. The U.S. Constitution does not say that the paramount duty of government is to "celebrate diversity" or to "embrace multiculturalism" or to give "every willing worker" in the world a job. The Preamble to the U.S. Constitution says the Constitution was established "to provide for the common defense, promote the general welfare and secure the blessings of liberty."
As our Founding Fathers recognized, fulfilling these fundamental duties is impossible without an orderly immigration and entrance system that discriminates in favor of those willing, as George Washington put it, to "get assimilated to our customs, measures [and] laws."

THE TRUTH ABOUT CRIME, ILLEGAL IMMIGRANTS, AND SANCTUARY CITIESby Ron Martinelli April 19, 2017
There has been much rhetoric from the left and the open-borders, pro-illegal immigration lobby suggesting that illegal immigrants pose no threat to the safety and security of this nation and commit less crimes than their American Citizen and legal immigrant counterparts.
If one watches the network newscasts, the ideologues and open-borders surrogates consistently accuse Americans and law enforcement experts who suggest otherwise of being racist and anti-immigration xenophobes. If you pay attention to the rhetoric, you will find one blaring item missing — facts.
I am a former Spanish speaking career detective who investigated violent crimes within the Hispanic and other ethnic immigrant communities.
I am also a forensic criminologist who is a subject matter expert in violent crime who advocates for facts and evidence. Here are some verified crime facts and statistics with you so that you will know the truth about the precarious relationship between violent crime and illegal immigrants.
As Americans, we should only care about three things: (1) are the immigrants in the U.S. illegally; (2) have they committed violent crimes predominantly against U.S. citizens; and (3) had these criminals not been in our country illegally, these crimes, the victimization of our citizens and the costs of their crimes borne by American taxpayers could have been completely avoided.
PREVIOUS ADMINISTRATIONS HAVE DELIBERATELY KEPT AMERICANS IN THE DARK ABOUT ABOUT ILLEGAL IMMIGRANT CRIMES
Most states and our federal government have kept information and statistics about illegal immigration, crimes committed by illegals and the costs borne by you the U.S. payer out of public view. It is in fact difficult, but not impossible to locate accurate crime statistics involving illegal immigrants. The statistics are buried both to suit a political agenda and to avoid public outcry. Once you read this article, you will quickly understand why.
The Pew Research Institute estimates that as of 2014, there are at least 11.2 million illegal immigrants residing in the U.S. This population comprises approximately 3.5 percent of our country’s population.
Of these, by far the largest ethnic population, 52 percent are Hispanics comprised of Mexicans, Central Americans and Cubans.
Six states: California, Texas, Illinois, Florida, New York and New Jersey account for 59 percent of all illegal immigrants residing in the U.S. The fact that 66 percent of all illegal immigrants have lived in our nation for over ten years underscores our long-standing inability to address, or to control, our nation’s borders.
THE RELATIONSHIP BETWEEN ILLEGAL IMMIGRANTS AND VIOLENT CRIME
Research conducted by the federal government oversight organization Judicial Watch in 2014 documents that 50 percent of all federal crimes were committed near our border with Mexico.
Of the 61,529 criminal cases filed by federal prosecutors; 40 percent or 24,746 were in court districts along the southern borders of California, Arizona and Texas.
The Western District of Texas had the nation’s most significant crime rate with over 6,300 cases filed; followed by the Southern District of Texas with slightly over 6,000 cases.
The Southern California District with nearly 4,900 cases; New Mexico with nearly 4,000 cases and Arizona with over 3,500 criminal cases ranked 3rd, 4th and 5th.
The U.S. Department of Justice documents that in 2014, 19 percent or over 12,000 criminal cases filed by prosecutors were for violent crimes; and over 22 percent or 13,300 cases were for drug related felonies.
That same year, the U.S. Sentencing Commission found that 75 percent of all criminal defendants who were convicted and sentenced for federal drug offenses were illegal immigrants. Illegal immigrants were also involved in 17 percent of all drug trafficking sentences and one third of all federal prison sentences.
The U.S. Department of Justice and the U.S. Sentencing Commission reported that as of 2014, illegal immigrants were convicted and sentenced for over 13 percent of all crimes committed in the U.S.
According to the FBI, 67,642 murders were committed in the U.S. from 2005 through 2008, and 115,717 from 2003 through 2009. The General Accounting Office documents that criminal immigrants committed 25,064 of these murders.
Illegal immigrants clearly commit a level of violent and drug related crimes disproportionate to their population.
In California alone, over 2,400 illegal immigrants out of a total prison population of 130,000 are imprisoned in the state’s prison system for the crime of homicide.
THE MISREPRESENTATION OF COMPARISONS IN WHO COMMITS CRIMES BETWEEN ILLEGAL IMMIGRANTS, LEGAL U.S. IMMIGRANTS, AND AMERICAN CITIZENS
The pro-illegal immigrant lobby consistently misrepresents the criminal involvement of illegal immigrants as compared to immigrants who legally enter the U.S. and American citizens, saying that illegal immigrants commit less crimes than their counterparts. This assertion is false in most cases. Here are the vetted statistics:
In California, there are just over 92 illegal immigrants imprisoned for every 100,000 illegals as compared to 74 citizens and legal non-citizen immigrants. In Arizona, the rate is nearly 69 illegals imprisoned for every 100,000, as compared to 54 citizens and legal non-citizen immigrants.
In New York, over three times as many illegal immigrants or 169, are imprisoned for crimes per 100,000, as compared to only 48 citizens and legal non-citizen immigrants. Only [in] the states of Texas and Florida do illegal immigrants commit less crimes than their legal immigrant counterparts (Texas with 54.5 illegals imprisoned per 100,000, compared to 65 legal immigrants and Florida with 55 illegals imprisoned, compared to 68 legal immigrants).
TEXAS IS AN EPICENTER FOR ILLEGAL IMMIGRANT CRIMES
Recent crime analysis by both the Department of Homeland Security (DHS) and Texas law enforcement authorities indicate that between June 2011 and March 2017, over 217,000 criminal immigrants were arrested and booked into Texas jails.
In researching the criminal careers of these defendants, it was revealed that they had jointly committed over nearly 600,000 criminal offenses. Their arrests included nearly 1,200 homicides; almost 69,000 assaults; 16,854 burglaries; 700 kidnappings; nearly 6,200 sexual assaults; 69,000 drug offenses; 8,700 weapons violations; over 3,800 robberies and over 45,000 obstructing police charges. In determining the status of these offenders in the U.S., it was confirmed by DHS that over 173,000 or 66 percent of these immigrant criminal defendants were in our country illegally at the times of their arrests.
“SANCTUARY STATE” CALIFORNIA POLITICIANS FIGHT AGAINST DEPORTING CRIMINAL ILLEGAL IMMIGRANTS
Currently, a fight is brewing between California Open Borders politicians and the state’s Democratic controlled Legislature and the Department of Justice regarding the protection of violent criminal illegal immigrants.
Hardly any Californians know that in 2014, Gov. Brown signed a bill that amended a state statute amending the maximum sentencing for misdemeanor crimes by one day from 365 to 364 days in jail. This was deliberately done to avoid current federal laws that provide for the deportation of illegal and legal immigrants in this country who have received sentences of 365 days or more.
With the newly enacted jail and prison diversion programs of Propositions 109 and 47, Gov. Brown and company are effectively preventing the federal government from removing violent and recidivist illegal immigrants from our midst through the deportation process.
THE EXTREME COSTS OF KEEPING ILLEGAL IMMIGRANT CRIMINALS IN THIS COUNTRY
According to research and statistics by the U.S. Departments of Justice and Homeland Security, U.S. taxpayers are footing an annual bill of nearly $19 million a day to house and care for an estimated 300,000 to 450,000 convicted criminal immigrants who are eligible for deportation and are currently residing in local jails and state and federal prisons across the country.
These figures include not only those immigrants who are in the U.S. illegally, but all immigrants here who commit and have been convicted of crimes. Other accounting estimates indicate that the total cost for all corrections, medical and support services for adults and juvenile immigrant criminals nationally to be over $1.8 billion dollars.
So the next time you hear some Open Borders politician or pro illegal immigrant surrogates advocate on their behalf, ask yourself why we as American citizens need to bear the increasing costs of violence, victimization and burdensome taxes in subsidizing illegal immigrant criminals who shouldn’t be in our country in the first place.
