i'm assuming that it can be done, tho its certainly underhanded. as long as dave doesn't make a formal offer, he's not technically breaking the rules.
plus, there's no guarantee dave will hold to his promise. it could just be a trick.
and, since agent's want only the best for their clients, they might not want to be willing to even consider such an informal offer (especially since one person made an actual offer, already showing a higher priority for the client).
