An interesting legal question. Does the name reside in the characters who make up the team, or is the name an external entitity capable of being commodified? If you're a comic book publisher, you probably believe that the name is an external thing that applies to whatever collection of characters comes together under that name. Witness what has tried to pass as the JLA, the FF, or the Avengers in years past. But I think the truth of the matter is that the core group of characters makes up the essence of the team, in which case the team comes into being if and only if the right group of characters is assembled. So, unfortunately, I don't think I can sell you the name "the Avengers" if you wanted to try to give USAgent and his cronies more legitimacy. But that doesn't stop you from marketing your properties as the Avengers or the JLA or whatever.
So team names are free. Every captain can have their own version of any team. Let the fans decide if your particular JLA, Titans, Avengers, etc. is authentic.
