Moore STOLE old SILVER AGE plots for his Superman rip off, but you're too fucking stupid to see it.

Changing how a character looks and what his name is but using the SAME concepts and the SAME plots is EXACTLY what a rip off is.

The judges in the Fighting American case and others take the view that if the essence of a character has been copied, then it is the subject of copyright infringement. Fighting American had a shield, dressed in patriotic colours, and had a similar-ish name to Cap America. The judge told Liefeld to have him stop using the shield, and it would be ok.

No judge is going to give anyone a monopoly over a character who has a cape, flies, and is strong, which is what you are saying has been established by Superman's creation.
