Marvel's view, and no doubt the views of their shareholders, is that they're private property and can't be used withouot permission of Marvel. Otherwise, why would people pay them license fees to use the characters?
I seem to recall that Marvel chased some game company a few years ago over the use of skins, but I didn't follow it closely enough....
