thats always been my theory -- especially in regard to fan sites (and/or other similar type thigns)
one of my earlier intern responsibilities at DC was to search the internet for people profiting from DC stuff (mostly porn sites that featured women dressed up as catwoman fucking other women dressed up as wonder woman ... many bookmarks no longer work).
mostly, they were not concerned with people who just had "i really like green arrow" web sites.
