It's a complicated issue, but here are the broad outlines of my position:
I think that, if the people want gay marriage, it should be created through legislation. If a state, or the entire country, chooses to pass a law allowing it, that's fine with me.
I don't think it should be created through judicial activism.
I can agree with the principle of your statement, however, legislators' often place their balls in a blind trust when elected. Frequently, the judiciary needs to step in and right a wrong the legislature won't address.
Gay marriage is an issue that most legislators would like to avoid. Last November a number of pundits placed blame for Kerry's loss on the shoulders of San Francisco Mayor Gavin Newsome. He was accuused of losing the Congress for the Dems, thus prolonging the war in Iraq and leading to the destruction of the world because he opened up the gay marriage issue. His response was classic. " I had no idea the Mayor of San Francisco had so much power ", His Honour replied. Of course the issue is now winding it's way through the state courts and I wouldn't be surprised if it lands at the 9th Circuit Court of Appeals. Meanwhile state legislatures accross the country have taken up the issue. Would they have done that without the fear of reform by judicial fiat?
