I liked that. It would be the normal reaction to gun down the killer if he was going free. Then fate stepped in and saved him from making that mistake, and the speech from Daws drove home what his parents would want. The whole point of the movie was showing how he became Batman and why, not silver age logic of "my parents are dead, I'll dress as a bat. 'nuff said."
