Because HHH is an egomaniac, and if anyone's gonna beat Cena and take the title, it'll be him. He could then go on to say that Y2J put him out of action, thus preventing him from even attempting to be the first Undisputed Champion. But then, that would mean the WWE would have to reference something that happened more than a month ago, which is taboo.

He didnt retire,he was fired.
That means it wasnt his choice,so if he does come back,it wont be seen as him backtracking.
The plan has always been that he will take off a few months to tour with Fozzy,so yes,he will be back in a few months unless he & WWE decide not to renew his contract!
Dont forget also,with the brand extension,he could always be rehired by Smackdown.
Also,like Grimm alluded to earlier,Vince has ultimate power,so in two or three months we could just see Vince rehire him on RAW anyway!
I know...I was just making fun of the "finality" of the match condition.

Foley lost a retirement match, and has only wrestled about 3-4 times since then. Not too shabby....

1) I did like how Shawn Michaels busted on Hogan without actually saying it, essentially saying "I was told to job to Hogan, and I don't much care for it."
2) I don't much care for this "Bad Ass" Kurt Angle. I miss the old, nerdy Kurt.
3) Could they have made Jericho POSSIBLY look like a whinier bitch?
