From what I've read Bush is skipping using a Judge to approve his wiretapping. And I haven't seen a good reason for him not using the FISA law that would allow him to wiretap first & then get a judge to OK it after. As noted above, U.S vs. bin Laden says in part that “Circuit courts applying (FISA law] to the foreign intelligence context have affirmed the existence of a foreign intelligence exception to the warrant requirement for searches conducted within the United States that target foreign powers or their agents.”



And I'm sure the inevitable investigation to come will take that into consideration. (if it's accurate I would say he's home free)
