O.K., so it seems to me that all of you are saying that it doesn't matter if the evidence was obtained illegally, so long as the provider of said evidence does not or, more importantly, can't be proven to work for or with the police.
Yes, but what I am also saying is that it would not be at all difficult to prove Batman works for the police.
1. Gordon, unless he wants to commit perjury, would have to admit it;
2. Other officers have seen Batman working with, and conversing with Gordon;
3. There is a big fucking spotlight on the roof of the police station that is used to summon Batman to work.
Furthermore, the prosecution has the burden of demonstrating that the evidence was not taken in violation of the defendants' rights. This must be proven by at least "clear and convincing evidence" and, under circumstances, "beyond a reasonable doubt." So the burden could be on the prosecution to show Batman isn't an agent of the police, not the other way around.
I really don't see how the prosecution could do that, given the above facts about the relationship between Batman the GCPD

The Bat-signal is problematic for Gordon. I think the relationship that Gordon and Batman have in the Legends of the Dark Knight stories works much better.
Anyway, I've always seen Gordon's relationship with Batman as something similar to the relationship some police officers have with private investigators. They collaborate on certain things and share information when it suits each other's needs, but by no means is the private investigator an arm of the police, officially or unofficially. It's not a partnership but more an unofficial relationship of convenience.

That might work, if not for the aforementioned signal and, further, the fact that the relationship is so regular. Really, at least once a month, no matter how you slice it, Gordon calls up Batman and asks for help on a case. That's different than an occasional relationship like you describe between the police officer and the P.I.
Furthermore, Gordon isn't just some beat cop. He's the Commissioner, the chief policy maker for the entire department. Therefore, when he enlists Batman on a regular basis, it goes even further to create the imprintur of an officially sanctioned relationship.

And that's why I like the Legends of the Dark Knight relationship better.

That's the JLA stressed and panicked. Think bigger.
What if Hal Jordan was deliberately infected with the Parallax bug by a DC Illuminati statistically anticipating Final Night?
What if Harbinger was zapped by a shadow demon and thereafter killed the Monitor because either he was a threat to the Illuminati or a rogue member of it threatening to leave?
What if Doomsday was purposively released to kill Superman and thereby draw out the Eradicator preventing the Earth from eventually being converted to a New Krypton?
What if Spoiler was allowed to be killed because she was actually a brainwashed tool of Kobra and would have been likely to have killed Batman?
And what if Lois Lane has been unknowingly sterilised, and Maxima allowed to die, to prevent Kryptonian hybrids taking over the world?
Machiavellian anticipation.

What if there was a DC Illuminati and Jeph Loeb was writing it?
Think gayer.

Well that would be that Batman and Aquaman are half-brothers and Alfred has AIDS.

So, the illuminati would be like Mopee, the magical imp who caused the lightning that created the silver age Flash?
