OH, NO JEW DON'T:WOODY SUES OVER 'RABBI' AD- Woody Allen didn't get the joke when American Apparel plastered photos of him dressed as a rabbi on billboards in New York and Los Angeles, and he's now suing the hipster clothing company.
The notoriously neurotic filmmaker hopes to laugh all the way to the bank, suing American Apparel for $10 million yesterday in a lawsuit that accuses the company of ripping off an image from his 1977 movie classic "Annie Hall."
The bizarre billboard ad appeared on the corner of Allen and Houston streets on the Lower East Side in May 2007 only to vanish days later.
The shot showed Allen with a long beard, hat, ringlets and glasses, with a Yiddish phrase that translates to "the holy rabbi" superimposed above and the American Apparel logo below.
A second billboard turned heads on the West Coast, and the photo was also briefly featured on American Apparel's Web site.
Lawyers for Allen delivered the punch line in Manhattan federal court, socking American Apparel with the suit, which accuses the company of violating his civil rights and implying that he endorses the company.
The photo at the center of the dispute comes from a scene in "Annie Hall"
"Allen was unaware that AAI was going to utilize his image on its billboards and Web site. Allen was not contacted, nor did he in any way give his consent to the use of his image and likeness and he was not in any way compensated," the suit alleged.
"AAI's unlawful use of Allen's image for commercial advertising purposes is especially egregious and damaging because Allen does not commercially endorse any products in the Unites States of America."
A spokeswoman for the company did not return a call seeking comment.
Unless there's more to this story, I don't see how the clothing company thought they could get away with this. It's fairly well settled law that you can't use a celebrity's picture (or even a reasonable facsimile sometimes) without permission to advertise a product. In fact, in one case, Frito Lay was successfully sued by singer Tom Waits for using a singer who simply SOUNDED like him for a commercial.

I think the point was that Allen, like a lot of US celebrities, won't do commercials or endorsements in the US (as opposed to places like Japan).

And my point was that Allen is a pervert.

So, when Roman Polanski moved to Europe, he was actually killing two birds with one stone?

Indictment on charge of rape and other sex offenses In 1977, Polanski, 44, became embroiled in a scandal involving 13-year-old Samantha Geimer (then known as Samantha Gailey). It ultimately led to Polanski's guilty plea to the charge of unlawful sexual intercourse with a minor.[7]
According to Geimer, Polanski asked Geimer's mother if he could photograph the girl for the French edition of Vogue, which Polanski had been invited to guest-edit. Her mother allowed a private photo shoot. According to Geimer in a 2003 interview, "Everything was going fine; then he asked me to change, well, in front of him." She added, "It didn't feel right, and I didn't want to go back to the second shoot."
Geimer later agreed to a second session, which took place on March 10, 1977, at the Mulholland area home of actor Jack Nicholson in Los Angeles. "We did photos with me drinking champagne," Geimer says. "Toward the end it got a little scary, and I realized he had other intentions and I knew I was not where I should be. I just didn't quite know how to get myself out of there." Geimer alleged that Polanski sexually assaulted her after giving her a combination of champagne and quaaludes. In the 2003 interview, Geimer says she resisted. "I said no several times, and then, well, gave up on that," she says.[8]
Polanski was initially charged[9] with rape by use of drugs, perversion, sodomy, lewd and lascivious act upon a child under 14, and furnishing a controlled substance (methaqualone) to a minor, but these charges were dismissed under the terms of his plea bargain, and he pleaded guilty to the lesser charge of engaging in unlawful sexual intercourse with a minor.[10]
In his autobiography, Roman by Polanski, Polanski alleged that Geimer's mother had set up her daughter as part of a casting couch and blackmail scheme against him.
In 2008, a documentary film of the aftermath of the incident, Roman Polanski: Wanted and Desired, premiered at the Sundance Film Festival.
[edit] A fugitive Before sentencing, Polanski was tipped off that the judge was going to disregard the plea bargain, in which case he would likely have faced a 50-year prison sentence. On February 1, 1978, Polanski fled to London, where he maintained residency. A day later he traveled on to France, where he held citizenship, in order to avoid extradition to the U.S. by Britain. Consistent with its extradition treaty with the United States, France refuses to extradite its own citizens. As a consequence, an extradition request later filed by U.S. officials was denied. The United States government could have requested that Polanski be prosecuted on the California charges by the French authorities,[11] but this option has not been pursued.
Polanski has never returned to Britain, and later sold his home in absentia.
The United States could still request the arrest and extradition of Polanski from other countries should he visit them. As a consequence, Polanski has avoided visits to countries that are likely to extradite him and mostly travels between France and Poland.
In a 2003 interview,[12] Samantha Geimer said, "Straight up, what he did to me was wrong. But I wish he would return to America so the whole ordeal can be put to rest for both of us." Furthermore, "I'm sure if he could go back, he wouldn't do it again. He made a terrible mistake but he's paid for it".
Polanski cannot return to the United States since the events of 1977-78, but he made it clear in his autobiography[13] that he never permanently resided in the USA. At the time of his 1977 arrest, he lived in London and was visiting Los Angeles. The arrest actually took place in the lobby of the Beverly Wilshire Hotel, where he was staying. Up to that time, he had directed nine films, but only two (Rosemary's Baby and Chinatown) were shot in the U.S.

In his autobiography, Roman by Polanski, Polanski alleged that Geimer's mother had set up her daughter as part of a casting couch and blackmail scheme against him. "Bitch set me up" isn't REALLY a great defense in a child rape charge. Even if what Polanski alleges were true, he still knowingly raped a thirteen year old girl, albeit with her mother's knowledge. That doesn't exonerate him, it only makes the mom an accomplice.

I'd like to think you're joking, but then I remember you live in San Francisco. This is, in fact, probably the sort of defense that would work on a jury there.

perhaps Roman Polanski heard his racist white grandmother say something bad, this would excuse him from wrong doing IMHO.
