Why is one legal and the other not? Makes no sense to me.

I'm not saying I agree with this theory, however, it boils down to the concept that the actress is being paid for her acting, not for the sex.

Acting is a constitutionally protected form of free speech, as is filmmaking.

If the performance of sex is part of his or her performance than he or she is getting paid for sex. Prostitution.

Mr Perkins is obviously only talking about hardcore porn in which the actors have sex for real, instead of only faking it, as in softcore or romantic movies. Even if having real sex in front of a camera will be considered as prostitution by the law (and the producer would then be considered a pimp), porn in which actors/models are only naked would still be legal.

If I was filming a murder, the murderer would still be liable. Doesn't matter if the filming was art or not. In fact, people would be screaming for the person documenting to be tried for a crime as well.

Flip it around and you'll see the problem with that. If prostitution were legal it could be regulated. The reason it's so much more dangerous than porn is that it's illegal.

And, yeah, I know prostitution is legal in many places outside the U.S. That's actually part of my defense.

In countries where prostitution is legal, safeguards are often put in place to protect the buyer and the seller--mandatory testing and the like.

Prostitution, even if regulated, will still have people putting themselves at risk (moreso than porn)!

I think there is a county or two in Nevada that prostitution is legal. There they have brothels with many safeguards and rules to protect both the client and the prostitute. I think the law still prohibits the street-walker type whores, though.

Also, many things are risky but legal. Driving down the road is risky. The fact that driving is regulated makes it safer, however.

At least with porn you tend to be with several people, and have big name companies you can go to, to avoid the risks!

You have girls getting into cars with a stranger and driving off because prostitution is illegal. If it wasn't, there would be houses with rooms with cameras and security.

Fact is, illegal or not, there are still more risks in prostitution.

Jumping a motorbike over a bus is even riskier.

First you ask how many people would be put off by being filmed and how many prostitutes would still get into cars. Both questions are unanswerable what if's. You can do no more than guess. I can do no more than guess. All I can say is that the legal brothels in Nevada do amazingly well despite the fact that they film their patrons. And girls flock to work in legal brothels.

Fact is, legal, it's not more risky.

Legal brothels are safer than street work for obvious reasons. They require that their girls get constant testing and they require the use of protection at all times. Add to that the fact that they offer a more structured system (patrons can choose the girl out of many in a well lit room, patrons can ask ahead of time for certain services, there's no fear of being beat up by a pimp) and it's no wonder that so many guys decide that being filmed is worth it, especially when confidentiality is promised.

I have - er - read that condoms are rarely used in porn. Would this mean that hardcore porn is more dangerous, as far as STD's are concerned, than legal prostitution?
